National defense is one of the most important functions of any government. One way to protect our country is by limiting access to certain places, so that if an attack occurs, not all of the damage will be done with just a single strike.

At a minimum, federal law under the ucmj articles and the Manual for Courts-Martial (MCM) mandates that military personnel accused of committing certain crimes within a protected place must be punished at a higher level than those convicted elsewhere. But what are these protected places? And how do they differ from regular restricted access? The answers, while not always clear-cut, can be found in this post.

We have put together this blog post on how the military deals with crimes against protected areas and why they are such a big deal. The consequences for violating these places can be harsh and often lead to lifelong incarceration at Leavensworth Detention Facility.

But before we go into that, we want to go over some basic rights, and then give you a bit of background information on this topic.

The Bill of Rights states:  "A well regulated Militia, being necessary to the security of a free State.... ." This means that people have the right to bear arms and be part of a state militia. The military themselves are obligated to protect us from enemies foreign and domestic.

Protected areas can be either a "place" like a park or a "person" like a doctor, lawyer, or scientist. When the military protects these places, they do so in the name of public safety. The public has the right to live and work where they please, provided that they do not harm those around them.

A crime that assaults an individual or their property must primarily affect that person or his/her property. If a crime against a person is committed, then first and foremost the victim must be safe and not brought harm. If the crime that was committed did not directly affect the victim, then the protection of another individual or property within that space is required.

The military has an important role to play in protecting all persons and property in these places whether they are "protected" or not. The military should always take crimes against persons as seriously as crimes against property.

What does the military do when a crime occurs that violates a protected area?

When another person commits an act of violence against the property of another, whether physical or mental, there are three major options for that person. First and foremost, this individual must take responsibility for his/her actions. If the individual is incarcerated and has suffered from these actions, then he/she should not be able to profit from his/her crime and should not be able to receive any form of payment or support while in prison.

The second choice is for the military to help protect that person. The military works very closely with the police, courts, and other government entities to ensure that these crimes are dealt with swiftly and appropriately.

The third option is for the military to take over the crime when it has been committed. This preserves basic rights and maintains a sense of order while ensuring justice is served. The case of Private First Class Bradley Manning was a prime example of this. There was no sense that the military would be taking over his crime. Instead, he was given options for punishment, and if he wanted to accept that punishment, we would allow him to do so.

If a crime against property occurs in a protected area, then the military has several options. The first is to work with local law enforcement to solve the case and ensure that those responsible are not getting away with it. If a person is responsible for violating the protected area, then he/she should be locked up. The next option is to ensure that a crime occurred by working with the person who committed the crime to make sure their rights are not violated at any given time. For example, if someone steals from you and then commits an offense against you, then we should have the ability to ensure your rights are not violated.

The third option is purely military in nature and deals with protecting an individual or a group of people from harm. The military will provide support to ensure the safety of an individual, or ensure that a crime does not violate the protected area. The military will make sure that a person who is fleeing the area is not able to return to it without first making things right with the community one way or another.

The final option is to try to solve the crime and uphold justice. It is important that we make sure that there are no injustices done against anyone during these crimes. Someone should not be able to profit from his/her wrongdoings and should not be able to flee from justice.
